A "salty" judge...

Delrahim was once again in the courtroom observing the proceedings on Monday. Hadas Gold emails from the courthouse: We heard from two experts, Ronald Quintero, who spoke on the supposed synergies and cost savings AT&T and Time Warner claim will come out of this deal, and Stanford economist Susan Athey, who said she does not believe the companies truly *need* this deal to be able to achieve the ad and content innovation they say they'll achieve as a result.
 
Judge Richard Leon was rather salty. This was one of -- if not the very first time -- he told an attorney (it was during AT&T's cross with Quintero) that they were done asking questions, cutting the attorney off. He also reminded the DOJ lawyer that they were on a redirect, not direct and not to ask leading questions. Leon also admonished a *witness*, Athey, telling her to just answer the questions directly instead of her long explanations on why the way the attorney was asking them was wrong, telling her "you're not teaching a class here..."

Nearing the finish line

Gold adds: On Tuesday we're expecting the government's last witness -- Professor Carl Shapiro, the government's expert economist who predicted the cost increase for all cable consumers as a result of this deal is expected to once again take the stand. He should be the final witness. Tuesday will be a half day. Right now we seem to be on track to have closing arguments on Monday, April 30...

The Hillman Prizes, presented each year by the Sidney Hillman Foundation for "journalism in service of the common good," will be officially announced on Tuesday... Here's a preview:

Aidan McLaughlin. He's been promoted to managing editor, succeeding Colby Hall, according to this Monday night announcement. Hall says McLaughlin will "help lead an expansion of Mediaite's staff with a larger mandate than any editor before him..."

A tale of two Hannitys

My latest column for CNNMoney: Fox News host Sean Hannity probably wouldn't like this guy Sean Hannity.

Here's what I mean: On camera, Hannity rails against "elite" media types who have inappropriately cozy connections with the rich and powerful. Off camera, that's exactly who Hannity is. A pair of stories in the past week have highlighted this on-air, off-air contradiction. First, the Michael Cohen revelation. Then Jon Swaine's piece for The Guardian about his "property empire." It called to mind this infamous Hannity quote: "Now, my overpaid friends in the media, well, they have their chauffeured limousines, they like their fine steakhouses and expensive wine lifestyles." More...

Hannity's response to the "attacks"

"It is ironic that I am being attacked for investing my personal money in communities that badly need such investment and in which, I am sure, those attacking me have not invested their money," Hannity said Monday. "The fact is, these are investments that I do not individually select, control, or know the details about..."

 -- Full disclosure: Hannity's attorney in these matters, Christopher Reeves, is married to a CNN executive.

Lowry's take

Brian Lowry emails: Like Bill O'Reilly, Hannity has always positioned himself as a man of the people, and their wealth is certainly no secret. The larger issue that Hannity has yet to adequately address is his failure to disclose potential conflicts of interest that almost anyone else working for a news organization -- including, yes, opinion hosts or columnists -- would be expected to make public.

As both Josh Marshall noted at TPM and unnamed sources told Gabe Sherman, there's room for skepticism -- especially given the breadth of his real-estate holdings -- that Hannity would need advice from Cohen. Marshall wrote: "Whatever Hannity was seeking Cohen's counsel about, it's unlikely it was about this stuff." Which means the question about the nature of their relationship hasn't been quelled by Hannity's explanation...

"What did he mean by breeding?"

At Monday's W.H. briefing, Sarah Sanders was repeatedly asked about Trump's tweet calling sanctuary areas a "ridiculous, crime infested & breeding concept." Jim Acosta asked first: "Was he making a derogatory term about Latinos in California?" Sanders said "No, he's talking about the problem itself growing and getting bigger." April Ryan followed up: "What did he mean by breeding?" Brian Karem also asked... And Sanders eventually said "I would have to ask him to be more specific..." What do you think, what are the chances she'll ask?

About that trip to Moscow...

The headline on Aaron Blake's latest: "Trump has some explaining to do about his 2013 Russia trip."

Trump's claim to James Comey (according to Comey's memos) that he never spent the night in Moscow is false, according to a plethora of reporting about the trip. On Monday Bloomberg even obtained flight logs that confirm his overnight stay.
 --CNN's Andrew Kaczynski tweeted: "I can't believe Trump even tried to claim this wasn't the case. He clearly was there for multiple days..."

Why Kanye's name is trending

Oliver Darcy emails: It feels like we're probably on the verge of POTUS tweeting out support for Kanye West. The rapper has gained notoriety amongst Trump supporters in recent days – The Daily Beast's Maxwell Tani has a good recap here -- after expressing support for commentator Candace Owens and sharing videos from Scott Adams, the right-wing author and Dilbert creator. On Monday, conspiracy theorist Alex Jones said on Twitter he admired West's "bold moves" and invited him on his program. Bill O'Reilly defended him in a column, writing that he was "under attack by the American Stalinists." And Fox News host Jesse Watters praised him on "The Five" as a "modern-day philosopher…"

Some historical context: West has always had pro-Trump leanings. He met with the president in Trump Tower shortly after Trump's election victory and said at a concert he would have cast his ballot for him, if he had voted. Trump has also heaped praise on West over the years...

Brave sources

The New Yorker editor David Remnick said something important on "Reliable Sources" that I want to underscore. When I brought up Farrow and the NYT's shared Pulitzer Prize for reporting about sexual harassment, Remnick turned the conversation to the bravery of the sources. It was a critical point since the segment started with the James Comey memo showing Trump and Comey talking/laughing about jailing journalists to ferret out sources.

"I think Ronan and the reporters at The Times would join me in saying that award, above all, goes to the sources, the women who were so brave to come forward," Remnick said...

HOW HAMAS EXPLOITS THE PEOPLE OF GAZA: PROTESTS CLARIFY THEIR CYNICAL TACTICS

It is time to create a stark public choice for Hamas: stop escalating tensions, and important rebuilding work will begin.

Hamas has never put the people of Gaza first. Hamas rejects Israel's existence and treats all of the land as an Islamic trust. The Palestinian people are instruments in the struggle to reclaim it. For the struggle, for the cause, the people can be sacrificed.

Why else would Hamas build tunnels to protect its weapons and its fighters but not its people during conflict with Israel? Why else, when Gazans desperately needed reconstruction, would its leaders divert short supplies of cement, electric wiring, and iron away from badly needed housing construction to build the tunnels?

Why else would it store, deploy, and fire its rockets in or next to schools, mosques, and hospitals? In conflicts with Israel, Hamas seeks to maximize Palestinian civilian casualties—preferably women and children. That brings international opprobrium on Israel and makes it harder to engage in its self-defense.

Recent mass marches on the border fence with Israel are a case in point. The Hamas leadership in Gaza announced that starting March 30 and continuing every Friday until what they call Nakba (catastrophe) day, demonstrations at the Israel border fence would take place. The symbolism was lined up perfectly for mobilizing public passions.

But, of course, that was not the real story. Life in Gaza is terrible, and Israel is not to blame: There are four hours a day of electricity, insufficient to power sewage treatment plants. Roughly 96% of the water is undrinkable. Unemployment runs close to 50%, medicines in the hospitals are consistently in short supply, and people cannot leave and feel imprisoned. With little money to pay for anything, trucks from Israel carrying material goods and humanitarian supplies are down from 1,000 a day to less than 200.

True, Mahmoud Abbas, the president of the Palestinian Authority, has deepened the economic deprivation by no longer paying Israel to provide electricity to Gaza and cutting payments to former PA employees there. His purpose was to pressure Hamas, and he did—so much so that Yahya Sinwar, Hamas' leader in Gaza—sought to hand governing responsibility back to the PA. While reconciliation talks resumed, Abbas saw them as a trap because Hamas refused to disband its Qassam brigades or disarm its fighters—and with the recent assassination attempt on the PA's prime minister, Rami Hamdallah, he is threatening further economic sanctions on Hamas.

For the Hamas leadership, with popular dissatisfaction growing, the only thing to be done was divert attention to Israel and, thereby, pressure Abbas, who cannot appear indifferent to Palestinians being killed by Israelis. As one European diplomat told me, Hamas leaders acknowledge privately that Abbas is the source of their current difficulties, but shifting the focus to Israel is a proven, if cynical, tactic.

Hamas knows that the world will see Palestinian casualties and tie them to the wretched conditions in Gaza—conditions that are blamed on Israel's blockade of the Strip. Of course, it is Israel and Egypt that control what can go into and out of Gaza. Unlike Israel, Egypt keeps its border closed to the movement of people and goods into and out of Gaza except on rare occasions. Hamas leaders have little interest in breaching the Egyptian border, knowing the casualties would be high and the international response minimal.

The risk now is escalation and another conflict between Hamas and Israel, leaving Gaza even more devastated. With its leaders believing they have little to lose, just one thing could change the Hamas calculus: the prospect of real change on the ground in Gaza.

The Trump administration needs to translate its recent pledging conference for projects in Gaza into a plan of action and a public challenge. Since it lacks credibility with Palestinians, it would be smart to get Europeans and Arabs to issue a joint public statement declaring that they are ready, immediately, to implement projects on electricity generation, water and sewage treatment, and reconstruction, provided there is no risk of escalation with Israel. No one is going to fund infrastructure projects that will be destroyed in another conflict.

It is time to create a stark public choice for Hamas: stop escalating tensions, and important rebuilding work will begin. Hamas leaders may treat the Palestinian public as pawns, but they are not indifferent to public pressure. It is time to create it.

Helping Egypt defeat jihadists is crucial, but it should be seen as a step toward ensuring the broader national security concerns that led Israel to call for a Sinai buffer zone in the first place.

In a February article for the New York Times, David Kirkpatrick wrote that Israel has conducted strikes against Islamic State elements in the Sinai no less than a hundred times since 2015. The story describes how jihadist forces operating in the peninsula under various names have been attacking Egyptian personnel for years. Yet it also highlights a broader security dilemma that Israel began grappling well before the Islamic State entered the picture.

THE SINAI AS A BUFFER ZONE

Since ancient times, the Sinai has served as a buffer separating Egypt from the peoples living to the east. The Israel Defense Forces captured the peninsula during the Six Day War, providing a small country surrounded by enemies with strategic depth. When negotiators met for peace talks at Camp David in 1978, five years after the Yom Kippur War, Israel insisted on resolving national security issues before it would agree to return the peninsula to Egyptian sovereignty.

Annex 1 of the Camp David Accords established a system of security arrangements that enabled Israel to withdraw from Sinai without incurring serious risk. Unambiguous restrictions were placed on Egyptian military activities and deployments in the area. The rationale was clear—in the event that Cairo's disposition toward Israel changed for the worse, Sinai would continue to stand as a buffer between Egyptian forces and the Israeli border. If Cairo sent any sizeable ground force or armed aircraft into the peninsula, it would constitute a clear violation of the accords and provide a warning of aggressive intentions. And if war broke out, Egypt's long Sinai supply lines would be exposed, especially to Israeli airpower.

To enforce the demilitarization, the United States took the extraordinary measure of supporting a permanent international troop deployment to the peninsula in 1982. Known as the Multinational Force & Observers, these troops were tasked with monitoring the Egyptian security presence in the Sinai to ensure compliance with the accords. The MFO remains in operation to this day.

In addition to suiting the logic of a country threatened by enemy ground forces, demilitarizing the Sinai also enhanced Israel's ability to defend against missiles and rockets. Naturally, the Egyptian army has continued to develop its missile capabilities over the years, so the existence of a huge 61,000-square-kilometer restricted zone is an important buffer against this potential threat, improving the IDF's ability to intercept incoming missiles if hostilities ever broke out.

In short, the Egyptian army was Israel's primary security concern on its southern border after the accords, so demilitarizing the Sinai was a good solution. This approach also enabled Israel to significantly reduce its own force size and defense budget relative to GDP.

JIHADIST REBELLION

The Mubarak government's decades worth of discriminatory political, economic, and social policies created fertile ground for radicalization in the Sinai, and terrorist organizations gradually exploited the population's resentment toward the authorities for their own goals. In the first decade of the twenty-first century, the peninsula suffered a series of high-profile terrorist attacks. More recently, during the so-called Arab Spring, anti-government unrest trickled into the peninsula once again, while terrorist and guerrilla groups renewed their operations. Fueled by an influx of weapons—purportedly smuggled from post-Qadhafi Libya—the most important of these groups, Ansar Beit al-Maqdis, quickly developed into a local branch of al-Qaeda, then later became Wilayat Sinai, or the Islamic State-Sinai Province (ISSP).

The violence in Sinai soon threatened the stability of Egypt as a whole, which was already at risk following the 2011 revolution and Mubarak's ouster. In conjunction with unrest in the peninsula, attacks began to increase in the Nile Valley as well. ISSP has since made operating against the Egyptian government its top priority, focusing its attacks on three types of targets: civilian officials and security personnel in the Sinai, local residents who oppose the organization's activities, and strategic targets that affect Egypt's economy.

As a result, the situation in the Sinai has steadily deteriorated. Large ISSP raids on local towns are relatively common, with dozens of fatalities each time, totaling hundreds of deaths in recent years. The group's most notorious operations included the October 2015 bombing of a Russian airliner (which killed 224 people and severely damaged Egypt's tourism industry) and the November 2017 massacre at al-Rawdah Mosque in the North Sinai town of Bir al-Abed (which killed 300 worshippers and wounded more than 100). The latter attack purposefully targeted a site frequented by Sufis, whom ISSP regards as "heretics." It was the most lethal terrorist operation in Egypt's history, shocking local residents, Cairo, and the rest of the world.

At the same time, ISSP has frequently demonstrated its hostile intentions toward Israel, though its main objectives—and the vast majority of its operations—still focus on harming Egypt. This has remained the case even amid the numerous Israeli strikes described in Kirkpatrick's New York Times story. If estimates regarding those strikes are correct, then it is reasonable to assume ISSP leaders are aware of the IDF's growing role in the Sinai. So far, however, they have not changed their policy toward Israel.

Now that Islamic State forces in Iraq and Syria have lost nearly all of their territory, the Sinai may soon become the organization's only remaining "province," making it a convenient haven for fighters from other fronts. The continued absence of Egyptian government control over the peninsula holds great appeal to the organization, giving it ample opportunities to extort resources from local residents and military personnel, expand its support among the population, and perhaps even capitalize on its proximity to the Israeli border. To be sure, the Islamic State and its supporters will do everything they can to continue operating in other countries. Yet realities on the ground will likely make Sinai their next focal point, so supporting the Egyptian army in its fight against ISSP is more crucial than ever.

ISRAEL'S DILEMMA

Bolstering the stability of the Egyptian state and strengthening its sovereignty in the Sinai is a strategic objective of the highest importance. In recent years, Israel has sought to facilitate this objective by agreeing to temporary modifications of the Camp David security arrangements. Since 2012, Cairo has repeatedly asked for permission to deploy large-scale armored forces in the peninsula, and Israel has generally assented, granting extensions to these treaty exceptions as needed. According to Kirkpatrick's report, Israel also actively assists Egyptian forces with intelligence and airstrikes in the area, while other Western analysts assert that Cairo has granted the IDF "carte blanche" to target Sinai militants with manned and unmanned aircraft.

Although helping Cairo is important, this objective does not obviate the original security concept underlying the Camp David agreement and military annex: namely, maintaining the Sinai as a buffer against any future hostilities from Egypt. The revolutionary events of the Arab Spring—especially the 2011 storming of the Israeli embassy in Cairo, followed by Egypt's election of a Muslim Brotherhood government a few months later—illustrated just how unstable the reality is, and how critical it is to keep the peninsula demilitarized in the long term.

Sinai therefore represents a dilemma for Israeli policy. On the one hand, Cairo should be offered as much help as possible to reestablish its sovereignty and prevent destabilizing shocks. On the other hand, as the fighting continues, it creates the potential for instability, and Israel should be prepared for any scenario. Thus, once ISSP is defeated, Israel should swiftly demand that Cairo reduce its Sinai deployment to a level approximating what is stipulated in the Camp David Accords.

POLICY RECOMMENDATIONS

The reality in the Sinai has changed completely since the accords, requiring occasional adjustments in the scope of the MFO's mission. Yet the organization will soon have a crucial role to play, not only in operational terms, but also as a show of American commitment to reinforcing the treaty's terms and demilitarizing the peninsula after the battle against ISSP is complete.

As for Israel's course of action, the Sinai dilemma requires a balanced and cautious policy in the immediate term. Assuming Kirkpatrick's report is accurate, officials on both sides are good at keeping their security cooperation a secret, but discretion alone is not a real solution to a deep problem. Israel and its allies should therefore focus on two main goals: restoring demilitarization in the Sinai by defeating ISSP, and maintaining Israel's "qualitative military edge" (QME) over neighboring countries.

Regarding the first goal, Cairo needs help from a broad international coalition to beat ISSP, so Israel and like-minded countries should equip it with the proper tools for that mission. Unlike Iraq and Syria, Egypt is a strong state that wants to take the lead in fighting ISSP. To do so, it would have to change its mode of operation, establishing a more effective command system and committing to comprehensive action on several different fronts simultaneously:

  • Defensive efforts. To hinder ISSP's freedom of operation and prevent the group from entrenching itself, Egypt would need to build a defense force capable of holding liberated territory and remaining active in North Sinai's main villages, cities, and transportation arteries.
  • Offensive efforts. Further progress against ISSP requires switching from a reactive approach (i.e., launching offensive operations only after terrorist attacks) to a proactive approach involving sustained offensive operations by special units based on precise intelligence. This strategy would increase the effectiveness of Egypt's campaign and decrease the number of civilian deaths, making it more difficult for ISSP to pit the population against the government.
  • Intelligence efforts. A more comprehensive intelligence approach is needed to prevent terrorist activities, with agencies in Egypt and other countries concentrating their efforts and combining forces as much as possible to better target ISSP.
  • Civic action. Reducing ISSP's recruitment numbers and improving intelligence collection against the group requires a more robust effort to improve living standards for Sinai residents. This could help isolate terrorists by creating distance between them and the wider population.

As for Israel's second goal, it should be remembered that demilitarization was not the only factor that enabled the IDF to feel comfortable about withdrawing from the Sinai. Just as important was the knowledge that its QME—specifically, its superior intelligence, fire, and maneuvering capabilities—would allow it to take advantage of conditions in the peninsula and defeat Egyptian forces if they attacked.

Israel used to be the only country in the region with advanced capabilities in intelligence gathering and precision attacks, but such features have become common to most armies since the Camp David Accords, including Egypt's. Two recent trends pose a particular challenge to Israel's QME.

First, Cairo has been acquiring advanced weaponry from abroad, and not just from the United States. It has purchased fifty MiG-29M/M2 fighter jets, fifty Ka-52 combat helicopters, and multiple S-300VM air-defense systems from Russia, along with four Gowind 2500 warships and twenty-four Rafale fighters from France. This gives the Egyptians strategic flexibility and lessens Washington's ability to limit what kind of military hardware they field.

Second, U.S. arms deals with other countries in the Middle East have reached massive proportions. Whatever the wider geostrategic purpose of such sales, they threaten Israel's QME.

The key to solving Israel's dilemma and strengthening its cooperation with Arab countries lies in (1) clearly defining what military superiority means in the current regional environment, and (2) helping the IDF increase and preserve this edge. Israel's excellent coordination mechanism with the United States has helped maintain QME in the past, but this coordination needs to be expanded in light of the above trends. A broad QME is the best way to encourage Israel's continued status as a stable and positive actor in the region.

Nothing says let's do some diplomacy more than a ceremonial tree-planting on the South Lawn, which the Macrons and the Trumps will do this afternoon at 5:25 p.m. The tree is a gift from Macron, an oak sapling taken from Belleau Wood in France, the site of a fierce World War I battle wherein approximately 10,000 American troops lost their lives. IVANA TRUMP SEEMS NICE:
Wow. Just, wow. Ivana Trump, Donald Trump's first wife and mother of his three oldest children, told Page Six that her soon-to-be ex-daughter-in-law, Vanessa Trump, who recently filed for divorce from Don Jr, won't be able to get a new guy because she has too many kids. "Maybe Vanessa will have a little problem because she has five kids ... Who is going to date and marry the woman who has five children? Especially since she is young and she might want to have more." 
She also says Donald shouldn't run for president again and he should just go enjoy his money and play golf.

The Senate Foreign Relations Committee is expected to vote today on secretary of state nominee Mike Pompeo, with a full Senate vote later this week.

What America is Talking About:
The hero who wrestled a firearm out of the hands of a gunman Sunday at a Waffle House outside Nashville. James Shaw Jr., 29, hid in a restroom when he heard gunshots, but ran out when they paused to try to stop the gunman. His arm was grazed by a bullet during the encounter, but he still went to church with his dad hours later. The alleged shooter was arrested in July 2017 for unlawful entry after he crossed a security barrier outside the White House.

Poll of the Day:
When it comes to combatting false information online, a majority of Americans believe it's up to tech companies. A Pew poll released last week found 56% of American adults believe tech companies should take steps to restrict false information online, and 58% believe the US government should not.

North Korea Says It Doesn't Need to Test Missiles Anymore:
Kim Jong Un said Saturday his country's nuclear testing is "complete" and "we no longer need any nuclear tests, mid-range and intercontinental ballistic rocket tests," according to North Korea's state-run Korean Central News Agency. Trump celebrated in a tweet. Kim is set to meet with South Korean President Moon Jae-In Friday.

DNC Chair Defends Lawsuit:
Democratic National Committee chairman Tom Perez defended the organization's lawsuit filed Friday that accuses the Trump campaign, Russia, and WikiLeaks of colluding during the 2016 campaign. During an interview Sunday on ABC's "This Week," Perez said the suit was filed because they don't want to miss the statute of limitations for filing and they want to deter misconduct, including the 2018 midterms. And, Perez said:

"We've done our homework. Over the course of the last year, we have seen story after story, brick after brick in the conspiracy between the Russians and the Trump campaign to affect the outcome of the election. I did my homework. We have a strong case. That's why we brought it."

Romney Now Has Primary:
Mitt Romney did not secure his party's nomination over the weekend at Utah's Repub Convention. Under the state party's rules, a candidate must receive 60% of the vote to avoid a primary. Romney received 49.12% and will face off against Utah state Rep. Mike Kennedy, who received 49.12%, on June 26.

Amnesty International Honors Kaepernick:
The group awarded Colin Kaepernick with the Ambassador of Conscience award. Kaepernick is "an athlete who is now widely recognized for his activism because of his refusal to ignore or accept racial discrimination," Amnesty International's Secretary General Salil Shetty said in a statement. Past winners include Nelson Mandela, Malala Yousafzai, and U2.
Shania Twain Apologizes for Saying She Would Have Voted for Trump:
In an interview with the Guardian, the Canadian country superstar said she would have voted Trump in 2016. She said:

"I would have voted for him because, even though he was offensive, he seemed honest. Do you want straight or polite? Not that you shouldn't be able to have both. If I were voting, I just don't want bullshit. I would have voted for a feeling that it was transparent. And politics has a reputation of not being that, right?"

But then Sunday on Twitter she apologized "to anybody I have offended," saying the "question caught me off guard," and that she does not "hold any common moral beliefs" with Trump. "I am passionately against discrimination of any kind," she wrote.

Kanye Voices Support for Turning Point USA Comms Director:
Ye tweeted Saturday that he loves the way Candice Owen, communications director for Turning Point USA, thinks. Owens responded by comparing Kanye to Trump ("Long before @realDonaldTrump came down the escalator, Kanye West was public enemy #1 for telling the truth," she tweeted), and she told Fox News, "the left wants to strap black people to this idea that they are victims – they want black people to focus on their past rather than their future."

Armenia's prime minister, Serzh Sargsyan, said on Monday he was stepping down from his post amid large-scale protests against his rule, he wrote in a statement. Anti-government protests erupted earlier this month against the pro-Russian Sargsyan when he was appointed prime minister as part of a new transition of governance that bolsters the role of the premier, effectively tightening his grip over the former Soviet republic in the South Caucasus. Sargsyan's political opponents accused him of changing the law so he could effectively retain power into a second decade.
